User Agreement

 Welcome to MiceTrade

All listings, bids or communications made through this website should be made in good faith.

This User Agreement constitutes the entire agreement between MiceTrade and members of this web site.

  1. Terminology
    • 'item', 'items' means goods or property that may be bought or sold through the auction or clasified
    • 'member' means a registered member of MiceTrade
    • 'services' means services offered by MiceTrade
    • 'we', 'us' and 'our' are a reference to MiceTrade
    • 'Website' means any MiceTrade website through which the services are offered
    • 'listing' means a listing on the Website through which you buy, sell or advertise any item or job by auction
    • 'seller' includes any person placing a listing on this web site
  1. Acceptance of the user agreement

    2. By registering as a member of MiceTrade you accept this user agreement.

  2. Breach of the user agreement

    3. If you breach any of the clauses of this user agreement, we reserve the right to limit your activities on the Website, remove your bids or listings, warn other members of your actions, issue a warning to you, suspend or terminate your membership, or refuse to provide the services to you. We can also use any other right and remedy available to us where we deem it appropriate.

  3. Warning

    1. We are not liable to anyone for anything in connection with any aspect of this web site or your use of it. In particular, we are not liable to anyone on any basis for any loss or damage caused to you directly or indirectly by use of this web site.
    2. We make no representations or warranties about any aspect of any item, listing or member of this web site.
    3. You use our services and our web site entirely at your risk. We take no responsibility for any system unavailability or for any loss or damage that is incurred as a result of this web site or services being unavailable. We assume no responsibility for the corruption of any data or information held by this web site.
    4. We provide no warranty or guarantee that this web site or it’s services will be error free or reliable.
    5. We provide no warranty or guarantee for the accuracy of information provided on this web site.
    6. We are not recommending or endorsing products that are offered for sale on this web site.
    7. You must not use our services or this Website to promote items for sale outside of this web site.
    8. You must not damage, interfere with or harm this web site or it’s services or any network or underlying system.
    9. You may not use a robot, a spider or other automated means to access this Website or information on it for any purpose.
    10. You must not copy, modify, create derivative works or publicly display any contents from this web site without our prior written permission.
    11. Failure to exercise our rights under this User Agreement does not amount to a waiver of the rights.

  4. As a member

    1. You agree to keep your membership information, including email address, residential address and telephone number, current at all times.
    2. You agree not to allow any other person to use this web site using your account.
    3. Each member may have only one membership account.
    4. You may not provide your membership details on your listings or in your feedback.

  5. As a seller

    1. You should be legally entitled to sell the items you are offering for sale.
    2. You must list auctions and classifieds in Australian dollars. All tax obligations are the responsibility of the seller and/or the buyer as mutually agreed.
    3. Your item description should be accurate and complete and include all relevant information about terms of sale.
    4. Your item description or item itself must not offend anyone based on race, religion or ethnicity.
    5. Your item descriptions will not include references to other web sites where similar items are offered for sale.
    6. You will not sell or offer services.
    7. You must not sell anything that is illegal, stolen or unsafe.
    8. You must not sell anything that infringes copyright or other intellectual property rights.
    9. You must not sell anything that is of a speculative nature including, but not limited to, pyramid schemes or similar schemes.
    10. The selling of firearms and ammunition is not permitted.
    11. You must intend to sell the items to the highest bidder if the reserve price is met.
    12. You will not attempt to manipulate the auction by assuming multiple identities.
    13. You will not charge unreasonable amounts for shipping and handling.
    14. You agree to your email address being given to the buyer when your auction closes.
    15. You must contact the buyer by email and provide the payment details.
    16. Listings are not pre-screened for content. We reserve the right to remove any listing that is in breach of this user agreement.

  6. As a buyer

    1. You are warranting that you have the legal right to purchase the items you are bidding for.
    2. Your bids are an irrevocable offer to buy the item at the bid price where there is no reserve price or when the reserve price is met.
    3. If your bid is successful, you must complete the transaction as specified in the listing’s description.
    4. You must make a prompt payment in full for any item you buy.
    5. You agree that your username and the amount of your bid are publicly shown on this website.
    6. You agree to your email address being given to the seller when you win an auction.

  7. Feedback

    1. Feedback you provide on other members must not contain insults, threats, vulgarity, disruptive or hostile comments. We reserves the sole right to determine what is considered an insult, threat, vulgarity, disruptive or hostile comments
    2. You may not give a feedback that contains another member's contact information.

  8. Fees

    1. We charge fees for the use of the MiceTrade web site as a venue.
    2. Fees are charged when items are listed and are only refundable if we accept that a refund is appropriate in the circumstances.
    3. Current fees are listed on our fees page.
    4. We will only issue refunds in the form of credit to the MiceTrade account of the member. Credits on accounts are not transferable between members.
    5. We reserve the right to change the fees charged at any time.

  9. Accounts

    1. Promotional giveaways of MiceTrade credits or any free credits gifted to the member on registration will not be refunded.
    2. MiceTrade accounts may not be used for the payment of items sold using the web site.
    3. A negative account balance must be settled immediately. We reserve the right to take action against you to recover any outstanding debt in witch case you are liable for expenses incurred when collecting that debt.
    4. If we terminate your membership or you choose to terminate your membership, we will refund the credit balance of your account less a $2 processing fee. Account balances of $10 or less will not be refunded.
    5. If we remove your membership due to breach of this user agreement, it is at our discretion whether you are eligible for a refund.

  10. Amendment of the user agreement

We can change this User Agreement at any time, without giving you prior notice. Amendments will be effective immediately upon posting them to this Website. Your continued use of the Services represents your agreement to be bound by the amended terms and conditions of this user agreement.
